So, I'm not sure I can show my face at the BreakTime on Nifong Blvd again.
I went in to get my Diet Mt Dew (I know, I know) before work this morning. I had a big presentation this morning so I got the larger size.
The Diet Mt Dew was OUT. :-( Nicely, the guy offers to change it while I wait.
When I got to the counter I set the drink down and reached for my wallet, then grabbed the cup to slide it over to the register. My thumb WENT TRHOUGH THE SIDE OF THE STYROFOAM (I know, I know) CUP!!!!!! spilling my beloved beverege. All over the counter. All over the floor. All over the chips. Under the register. NightMare!!!!
As the man runs around to put up wet floor signs and begin to mop I proceed BACK to the soda fountain to get another drink. I turn around to go back to the register and proceed to SLIP ON MY PREVIOUS SPILL and faceplant myself right infront of the register, crushing the Diet Mt Dew into my chest as I fell on top of it.
Laying sprawled out in front of the register soaked with 88 ounces of Diet Mt Dew DURING RUSH HOUR. I begin to laugh. Except I hear people saying "Is she laughing or crying?"
The manager comes over and helps me up. GETS ME ANOTHER DRINK, which he announces in on him and he hopes I have a better day and HELPS ME TO MY CAR.
I go to work.
Did I mention I have a huge presentation at 8:30 in front of 125 of my closest colleagues? Yes. I presented STILL WET.
As people asked why I was soaking wet, I told the aforementioned story.
I HAVE HAD 4 PEOPLE TELL ME I SHOULD SUE......... WHAT?
It was my fault.

I IGNORED the wet floor signs and walk THROUGH the spill to get my drink and then THROUGH the spill AGAIN to get back to the counter.
On what grounds would I sue?
Yes, I scraped my right knee. Yes, I am going to have HUGE bruise on my left hip and for some weird reason my left BOOB hurts. I may have re-jacked up my neck...... already had physical therapy for that last year - thank GOODNESS my deductible has re-set and I'm back at $0 for the year :-(
But sue? Why?
Why are people so quick to sue. And they weren't joking around. One of them gave me his lawyers name.

oh my word!! because that's the nature of our left-leaning society. I am sure that some on here will be offended by that - however - that is MY OPINION!!!
Don't take responsibility for your own actions (which you recognize that you caused this - and the store manager acted appropriately with the signs, etc.) and make sure you get money from them for it!!

I don't know why people are like that. I'm sorry all that happened to you, sounds like you have a GREAT sense of humor about it all, though.
My husband and I are always dumbfounded by the quickness with which people default to "sue somebody" for stuff also. We often quote a cousin of his who, after listening to someone tell a similar story to yours, interjected with, "I would OWN that place!".

Sue happy, I have no idea. If I just had a dollar for every time someone told me I should sue I would be living quite comfortably. I am not very litigious, I guess I prefer to earn my money. Being a klutz should not be a career choice, ya know? :p

Sue happy??? Because some people are too lazy to take personal responsibility and EARN money the old fashioned way..... by working! They prefer to suck from those who are hard working.
I've mentioned an ex neighbor before who was at a neighborhood party. She had a bit too much to drink and revealed how they made about $50,000 a year from slipping and falling at various places. Funny... they moved after a year or so because they were no longer involved in our neighborhood parties, etc. Why? No one wanted them on our property because no one wanted sued. And our neighborhood is a upscale.
An acquaintance of ours sued everytime he left a job or had some reason to threaten to sue. They moved to a $1.5 million home and within 3 yrs, moved again to a home that is about $3 million. This schmuk has never really worked... all he does is sue. The reason they move? People figure out who and what they are so they have to move and make new "friends" every couple years or so. At one point, his "friends" around here (including my hubby) told the lawyers to stop wasting their time to call them in for character witnesses because they had REAL jobs and were busy working to provide for their family... not spending all their time in court helping this guy screw anyone and everyone he could. You'd think they would realize karma. His wife called me in 2000 bragging that the MIL "FINALLY DIED" and they now had all her money. Within 2 weeks, her 14 yr old daughter was killed in a car accident.
Last, I busted my butt in a nice restaurant a couple yrs ago. Management was all over me offering free meals, etc. The manager actually called me as asked if I was suing. I said "WHAT".... even though there might have been a drop of water on the floor, I am not the type of person to run lawyer up if I think there is a chance to get a buck.
I am not surprised you were given lawyer names. Same thing happened to me.
We prefer to earn our money ethically and work for it vs screwing other people for it.
ETA: Rosebud... I also hope Karma was not the teen daughter. Possibly, it is just the way things worked out at the time and it was ironic that the 2 incidents were so close together. You are right, it was not the teen's fault that her mom and step dad are immoral. She was a beautiful girl, inside and out.

I got rear ended. Not too much damage (about $1500 to my car, and ER/neurology/physical therapy for me. Not including ER fees, maybe 2k).

It was 100% not my fault.

So that's one reason why: unless they do sue, the other party is not willing to do the right thing.
I'm reminded about a beach vacation I once took, during which an elderly British couple at my resort slipped and took a nasty spill as a result of a leaking air conditioner on the tile floor of their room. They were just hoping that the resort would pay the doctor's bill for treating their injuries — they were flabbergasted when the Americans in the group pressured them to sue.
The prospect of money makes even sane people think crazy things.

It's just disgusting that people suggest that you sue. Sure, you could probably sue and get some free money for your clumsiness.
But you have integrity and humor, and you are better than a lot of people these days, who would do something immoral for money. I think a lot of it has to do with the burgeoning entitlement attitude in this country (which is cultural, NOT political, IMO, so not restricted to left-leaning people).
Good for you. You have the right attitude, and you will go far.

Riley -- there are real and just reasons to sue, and it sounds like you have one.
It's all because of the entitlement mentality that is taking over our country far too quickly. And I blame that on people not teaching their children to work hard and earn things, and on politicians for buying votes with promises of free housing, food, health care, and cell phones. Go back 40 years and you didn't have this problem.
Yah, I'd have to agree that I'd find a different source for my Dew fix for some time to come. Or maybe stick to plastic bottles and cans? But thank you for the chuckle... I can totally see me doing that. I'll not look at a styrofoam drink cup the same way ever again.

I think too many people think that somehow they are entitled to more than they have, are not getting their "fair share" and somehow suing someone is going to "even the balance."
A friend of mine had some friends over at their house for a get-together last fall. They have a tiled hallway floor alongside the kitchen - the tile is dark and there is a step down at one point that if the area is not well lit, can be easy to miss. One of her friends missed the step while walking through and slipped a little, but was fine - and her husband made fun of her for missing the step and not being more careful. Not even 10 minutes later, HE does the same thing! Only this time he falls down and manages to tear his ACL in his knee and needs an ambulance to come and take him to the ER because he can't stand up or walk, and now he's out on disability from his job for several months and may need surgery. My friend apologized profusely and felt horrible, but then this friend stopped communicating with her, except to keep telling her how badly her husband was doing, how much money this was going to cost them, lost income, etc. My friend has talked to her homeowner insurance company and they have advised her to let them contact them, rather than offering compensation in any way. She is stressing out thinking that this couple is going to sue them, because that's the kind of parents and family that THEY have- they want to go after everyone over everything. Whereas the guy was already aware the was a step there, he made fun of his wife for tripping on it, then managed to the same thing himself because he was not being careful.
I am glad that you are not one of those people, and you are honest about taking responsibility for the incident, and also seeing that sometimes accidents happen - hope the rest of the day goes better!
ETA: As a vet, on occasion, I have a pet owner threaten to sue - usually because something went badly with their pet, they are upset, and they think that somehow I am at fault and I must have done something wrong. In every case, it ended up going nowhere and was just an empty threat. In one case, I had diagnosed an owner's sick cat as diabetic and explained what was involved with treatment, management, recommended having the cat hospitalized to start insulin, etc. Owner never followed up and then 3 months later we get an angry letter saying that her cat had had vomiting and diarrhea all this time and I had done nothing to address it and now her cat was dead after it suddenly passed away at home. Fortunately, everything was documented in the pet's file, including my conversation with her when the cat was diagnosed, and at no point did the owner call us back to let us know what was going on with the cat. But she thought she had a case and could sue. My boss stood up for me and let her know she could very go ahead and talk to a lawyer, but after reviewing everything, she didn't have a leg to stand on. We never heard from her again. I also had an owner get upset at me because she had to euthanize her dog after it developed a bloot clot in it's aorta and it was not treatable. I had just seen the dog a week before for an ear infection (so nothing at related to the blood clot at all) and at that time the dog was fine otherwise and there were absolutely no signs of anything else being wrong. She thought we should compensate her for the office visit and the ear medication because somehow I "missed" the blood clot and should have been doing more tests, like bloodwork and x-rays. But I am not going to run $500 worth of unrelated diagnostics for a dog that has an ear infection and even if I had, there probably would not have been evidence of a blood clot, and even if there were, it wasn't going to change the outcome anyway. She still believes she is entitled to compensation because she lost her dog, even though the ear infection had nothing to do with what happened and she had left the clinic with the ear medication and had used up half of it before the blood clot was diagnosed. People are just crazy and ignorant sometimes, and/or don't want to take responsibility for their own mistakes, or realize that sometimes unexpected things happen and it's not anyone's "fault" - it's just life.

It may be because our entire government is hijacked by rich greedy soulless people running the top few corporations in order to keep more and more profits to themselves while not having to be responsible for anything or contribute anything. And the rest of the people whose lives are basically owned by them feel powerless and sooner or later are taken over by it themselves, with the if you can't beat em, join em Attitude. "Everybody else is doing it." Get rich quick! These people who vote to bail themselves out after the failings of their own deceitful fraudulent illegal ways are up there right now arguing against federal relief for innocent victims of a natural disaster. People see how the system is rigged against anyone getting anywhere by working hard for a good honest living. It's either sue one of the big corporations, or win the lottery, or live hand to mouth while the 1% keep getting more rich and powerful.
I am sorry for your misfortune, and I have to say I am impressed by your positive reaction and the fact that you could laugh in the face of it, go to work and give the presentation! God bless you!
Btw yes man dew contains so much caffeine and my doctor told me caffeine could be the cause of my sore boobs. I stopped drinking caffeine and breast pain went away.
I have no IDEA why people always jump to that. I totally agree with you its an accident and partly your fault. Outside of the cup being so cheap you put your finger through it to begin with...lol

Sue happy? I don't get it either. The problem is, these people that are "sue happy" don't realize that the cost of the lawsuit is passed back to them & EVERYONE else through higher cost of products, higher insurance deductibles & rates. That money does not come magically out of thin air or the company profits, it comes from the insurance carrier, who may also be your insurance carrier. It is stupid (unless legit negligence is established)!
There are times when true negligence is involved & the other party should pay or contribute to a loss, but a majority of the time it is the initial person's own fault at the start, being the cause of the effect.
Sometimes, such as medical malpractice suits, there aren't any good options. You have to take the lesser of two evils, option A with a 50% chance or option B with a 35% chance...so either way you have a high rate of a bad outcome. People still sue and of course we all know healthcare is screwed right now (for more than one reason). Just another example of the suits being passed down to EVERYONE else.
I work for a company that are expert witnesses for attorneys on some of these cases. Many we handle are on the defense side & it's like "what are they thinking?" We had a Plaintiff attorney in our office speaking on his cell right in front of me telling the person on the other end to see if there was anyway they could make a connection between an incident that happened to his client 6 months before and the incident that he was currently working on so they had more options.

And for a second there, I thought this was going to be about the store owner suing YOU for ruining his register or something. I agree with you. There are plenty of legitimate reasons to sue someone - this isn't one of them. And it is sad that people are urging you to do so. Very sad.
and this is why the price of everything goes up and up and up. because of sue happy people. if you were wronged sure sue. but yes it was your fault. laugh it off and be on your way. i would never sue a friend either that is the best way to never have friends. people are crazy. america has become a country of everyone owes me something attitude. thats why we are in such trouble. and yes i can make this political.
Well.... let's look at it objectively. You went to pick up the cup and your thumb poked through it. That's a defective cup. You could say that the entire situation wouldn't have occurred if the cup weren't defective. The fact that you were buying the drink, and then after it broke you went to get a new one, ignored a wet floor sign and thus fell in the mess you had made from the defective cup, doesn't preclude the fact that the cup was defective.
So take the manager's eagerness in helping you. He probably knew this. That's why he was falling all over himself to help you up and get you a new drink and to your car. He did all this, I'm guessing, before you requested filing an accident report from falling? Did he suggest an accident report, because he should have.
You say right here that you hurt your knee, your hip, for some "weird reason" your breast hurts, and you think you reinjured your neck in the fall. All of this goes back to "because a defective cup spilled a drink when it was picked up instead of performing its intended function and caused C. to fall."
I hope you at least go get yourself checked out to see about the injuries.
EDIT: I'm NOT saying you should sue. Only that you should get your injuries checked out, and as someone who worked in retail for a long, long time you should have filled out an accident report.
Also, the lawyer who was suing on behalf of the Sandy Hook girl that survived and was traumatized withdrew the filing. He has no basis for a lawsuit, and in order to file the lawsuit he would have to file against CT or Newtown and not the school. He would have to be granted permission from the State of Connecticut to sue the town or the state and chances are slim to none that any lawsuits will allowed to be filed like that.

I always walk through those areas because really half the time I can't get around them... And half the time I slip and fall on my butt. I have never even considered suing for that!
That kind of reminds me of a time when I worked at a really small store in the town I grew up in. This one was totally my co-workers fault. It was between winter and spring so everyone's shoes were muddy, meaning the store's floor was also muddy. It was about an hour before closing and my co-worker decided to mop the floor and hour early so that he could leave early that night (Boss said it was okay). HE DIDN'T PUT SIGNS DOWN! (Idiot). A customer, who was in her late 60s/early 70s, slipped backwards and landed on her hip. She couldn't get up. The lady she was with (Also in her late 60s/early 70s) was trying to help her but couldn't. I saw them struggling and walked over to find out what happened (Because I didn't actually see it happen). The lady wanted me to just help her up so she could get home and watch the new episode of 'Lost'. I was having a hard time controlling my laughter (Because really, who is that concerned about lost). But really, she's old and couldn't get up because she hit her hip so hard. She needed to see a doctor and since it was so late that meant a trip to the ER and since she couldn't get up on her own and we didn't want to do more damage that meant an ambulance. So, since my boss was doing who knows what (He generally stayed in his office and watched TV during work hours, ignoring any communication from us), my co-worker (The only other person in the store) and I taught ourselves how to fill out an accident report, take lots and lots of pictures, and convince an old lady to let the EMTs actually help her. It was a fun day...
