A. - You need to get Dave Ramsey's program. I don't have a good attorney to refer you to - but regardless of whatever defense you acquire, you need the tools to learn how to manage your money, get out of debt and build savings at the same time. If you go through this process without gaining those tools for yourself, you will find yourself right here in the same spot over and over again. You owe it to yourself and your family to be smart - and to control your money instead of allowing it to control you. My husband and I took Dave Ramsey's Financial Peace University program and it has changed our lives. We are paying down debt rapidly - we are building savings at the same time, every dollar that comes in is ear marked and named - we successfully pulled Christmas off on a budget and this program has removed the stress of worrying about money.
I hate to say that going the consolidation route and then taking loans to pay off your debt were not smart decisions, all you did was transfer your debt and the banks are continuing to make money off of your money, causing you to owe more than if you would have just paid your debts directly.
Start with your four walls. Stop paying your credit card bills. Captial One (or whoever) is not going to lose their house...you can pay them later. The most important thing is mainting your FOUR WALLS - that means your home, utilities, food and vehicle. Those are MUSTS for living. Nothing is more important. The rest can be handled once you take a look at what you have coming in, going out and then you dig out, one baby step at a time.
I don't think debt consolidators can take your house - you'll need to read the terms of your loan to see exactly what you allowed them to leverage. Either way, it's time to take a good hard look at how you found yourself in this position - AND CHANGE IT. Change it now - you owe your children security.
I am sure this feels totally overwhelming to you right now - but if you will take the time to learn how to regain control (instead of allowing the bankers control you) you will feel more in control everyday with a good solid plan. If you fail to plan, you plan to fail. That simple.
