my doughter is now 7 years old..when i had her i did not give her her fathers last name...can i just send in the declaration of paternity with his signiture and will it change?or do i have to go thru court and the whole 9????

If you had her at Antelope Valley Hospital, you will be able to call them and ask them.

I don't know what changes have occurred in the California state laws regarding birth certificates...

Are you changing her name or just declaring who her father is? If you are changing her name - in MY OPINION - you will have to go through the whole 9 yards....birth certificate name change, social security name change, passport name change...and anything else that you have her on - insurance, etc.

If you want to change her name it needs to be done thru the court system. A name change has nothing to do with paternity.

Sorry, you will have to file paperwork at the court house, you will have to go to court and you will have to pay to file the paperwork, currently it's $435.00.

I would call the vital records clerk to see what their requirements are. In Chicago, my niece was told she would have to file a request with the court, signed and agreed to by the father, and pay the court fee. I don;t know what that is or what kind of papers. She never bothered to change it. It is not like actually going to court though and standing before a judge.

I think if you call the Vital Statistics office in your state or the state she was born in they can give you the legalities. I think that any change to a birth certificate must go through the court system but I really don't know.

You have to go through the court then you have to send everything into Sacramento and wait FOREVER to get the ammended birth certificate.
