When my second son was born I wasnt married to the father. Had him in a catholic hospital and they would not let me give him fathers last name. Later n the years we broke up and ex changed birth cert, where my son had my last name and his how can i give him his fathers name and take my last name off, birth certificate?

Yes, I agree that you will most likely have to apply for a name change. Also, if you change his name I think that every time you fill out major paperwork you will have to fill out a name that he was formerly known by. That is no big deal if this is something that you really want, but it is something to think about.

My daughter is my biological neice (I have had her since she was ten days old and was there when she was born) and we are the permanent legal guardians. Adoption wasn't necessary because of the situation we were in and probate court. We changed her name and never had to notify the biological parents but had to file for a name change through our local superior court and put a notice in the newspaper for four weeks (that part with the small print that nobody reads). The birth certificate, social security card, passport and such was able to be changed. I didn't have an attorney for the name change, I did the forms myself and they were pretty easy. Good luck!!

You can change his name through the courts and they will issue it changed on the birth certificate. Did his father sign an acceptance of paternity?

You should be able to handle this yourself with some leg work if his Dad is not fighting it. If he has not signed an acceptance of paternity you can't just put his name on the certificate and change your sons name. You will need to go through the courts and establish paternity.

My husband adopted our son when he was a year old, they added his name to the birth certificate and legally changed my sons name. We were issued a new birth certificate showing both changes.

I don't think you can change the birth certificate but you can apply for a name change.

Wow, I have never heard that about hospitals not allowing you to put the name of your choice on there. I have heard that they wont put the fathers name on without additional steps, but not the last name part. What hospital did you have him at?

I'm pretty sure you cannot change a birth certificate.

Yep, the birth certificate is record. You need to look into legal name changes.

So what's wrong with your child having your last name? It was my former husband's idea that our daughter have my last name! I am very grateful for that offer, and especially since we are now divorced, she and I share the name. I wouldn't waste my time dealing with this. Be proud of your name and share it with your son.
