Do you legally have to put the father's name on the birth certificate if you're not married to the father of the child?

Best to think this through carefully. Collecting child support will not be easy, should you ever need it, but if you don't want visitation hassles, it's the way to go. Also from the baby's standpoint, is this a family that might contribute one day either through support or history? Do consider that the subject will most likely come up one day. Do you have an explanation ready that would satisfy you if you were in your child's place?

PS...Also might want to consider collecting all the medical history you can on the real father either way.

I did not, We were married but separated. He left when I was 16 wks pregnant and did not become involved until my son was 6 months old.

You do not need to. I still would not if I had to do it all over again.

Don't have to, and wouldn't worry about the child support thing either, it has nothing to do with the birth certificate. If you do want to collect, then they will establish paternity either by blood test or he can sign an aknowledgement of paternity. He will be asked if he wants the birth certificate to have his name on it or not at the child support hearing.
Just my 2 cents....if you don't forsee him being in the picture, don't put it....One main reason is that if there is a name there, then in cases like passport application, you have to have his signature to get the passport for your child. What if you can't find him? What a headache. If you do think that he will be around, then why not? Truthfully, my heart sinks everytime I look at my sons and there is no name on the father section. It is a bit depressing, however, his biological father chose for it to be that way, so, I can't be the moral police. Everyone has disappointmens in life. It really sucks that my sons has to be such a huge one.

No, but if I were you I would really think it through. You should do what's best for your child, and you can't think about what's convenient for you. I went through the same situation with my boys, but I ended up putting him on there and we reconciled. Even if the father doesn't want to be in the child's life, I'd put him on there just in case down the road he does. Or think about the child, what if they want to track down their father one day? Just so many ways this could end up hurting someone. =/

No you dont have to, but if you are married and the baby is born with in 3 months of marriage the fathers name is automatic. Under Texas law, if a man marries a preg woman and she delivers after 3 months of marriage the child is legally his, no matter the paturnity. Also under Texas law if you divorce and the father is not the bioligical father but falls under neith the above texas law he still has to pay child support (got a friend pay for one of those) Once paturnity is established most courts will automatically add the father to the birth certificate. Some Courts wont do it unless the father asks. I wonder, you asking for your self or for a friend. It says your married on the "a little bout me" part.

My best friend just had a baby about 1 month ago and when she was filling out the bc form since the father was not present she could not even put him on it if she wanted to. They have to be there to sign it and if you think he is not going to be there when you have the baby than you shouldn't have to worry about it.
