my two yr old got bitten twice in the same day at day care. it was pretty bad bruise and bleeding. my question is can you legally file a claim against the daycare for pain and suffering?

What are you going to do? Sue a 2-year-old for biting, or the daycare worker for not running across the room fast enough to stop him?
That's ridiculous. You don't sue for something that happens all the time among kids. Yes, it's unfortunate your child got hurt, but your reaction is way out of line.
Your daycare center probably has a policy about biters. The one daycare I know of sends the biter home immediately, and if he or she bites again, is asked to leave the center for a few months or until the biting habit stops.

I am so sorry that happened to your child.
Honestly, I think it is silly that you would try to file a claim. The daycare didn't bite him, another child did. I am sure the bite hurt your child at the time, but now who is really in pain, your child or you? It seems like there is always a biter in every toddler classroom. It is always unfortunate when it happens. What would be more worth your time is fighting DCFS or NAYCE to lower the ratio between teachers to children in the daycare setting. That is the big problem in my opinion. To many children and overworked/underpaid teachers and these types of "accidents" are all too frequent.

Honestly, it seems to me that your concern is misplaces: Are you concerned with getting money, or keeping your child safe? If you believe this is an unsafe environment, get your child out. Obviously, this can't be allowed to continue, but your getting money will not make your child feel better!

If you are truly looking out for your child, I would think that you should immediately make the faculty aware of the situation, and then I would pull my child out of the day care.
