Looking for a Good Divorce Lawyer

My husband moved out of the house and left me 3 months pregnant with two young kids at home. I am looking for a good divorce attorney to help me through this. I am not from Texas and was told you can't get a divorce while pregnant here. Does anyone have any suggestions or advice on this? I would like to move back home to Colorado where I am from so I could have family to help me, but my husband said he would stop me from taking the kids out of state. Help...

If you want to move back to CO you should do it while you are still legally married. Once you file for divorce in TX they may say they don't want you to take the children permanenty out of the state. A divorce attorney can advise of this.

L., I don't think he can stop you from taking the kids out of state because you aren't divorced and you both have custody but I do think that he still has full rights and if he wanted to he could get them from school or daycare and sort of kidnap them but it's not considered that because he is their father and you are still legally married. So whatever you do it needs to be quick and surprise for him.

Since I don't know the details of your situation, I'm not sure how involved with your children your husband is. However, if he is a good, loving father, I would re-consider the advice to move out of state quickly and quietly. No matter what issues I have with my husband, I know that he is a wonderful, loving father and wouldn't deserve for his kids to be snuck away from him.

I would have my family help me move to Colorado as soon as possible. Don't even think about lawyers or papers. You are in a desperate situation and no one will think twice about you moving in with your mother or sister in this situation. Do it as quickly and quietly as possible. Find a little job that you can do without jepordizing your pregnancy, get on Medicaid in Colorado as soon as you get there. Start getting prenatal care as soon as you get there. The medicaid office will be able to help you know how to do that. Change your driver's license as soon as you get there, register to vote. Do all the things that will help you establish that this is where you plan to stay because your family is there to help you.

I can only add that if you and the girls are safe and your husband is not abusing you, please try to communicate. I know you have less tolerance for ridiculousness because you are stressed ou, a busy mom and pregnant, but in the long run, if he's a decent father, you have to try and preserve a relationship between both parents and their children. It sucks, I know and much easier said than done. I'll be thinking about you, Mama.

"Also in Dallas county, you can not move anywhere except to a contiguous county without the court's approval and/or your ex's approval if there are kids involved." This is true ONLY if divorce papers have been filed by either of you! I just went through a similar situation in January. The advice from my attorney was to move out of state & set up residency in the state I wanted to live in as quickly as possible (BEFORE any papers were filed). Then I would have the option of choosing to divorce in Texas or the new state. Texas is very "co-parent" friendly, even if it's not in the best interest of the child. If your husband has moved out already, then get your family here as quickly as possible to move out of state without your husband knowing. I was able to do it overnight with help from my family. Also, you'll want to sign up with a temp agency as soon as you get there. It's much harder for Texas to impose residency restrictions if you are already in another state, especially if you are working!

Yes, in the state of TExas you can not get a divorce while pregnant. Also in Dallas county, you can not move anywhere except to a contiguous county without the court's approval and/or your ex's approval if there are kids involved. You can file for a divorce any time and start the action but the divorce will not go to court till after the baby is born. Have you talked with your pastor about the situation? Since your husband has abandoned you and your children you have the charges to file. I do not know your financial situation but check any attorney suggested with the BBB and go on line to confirm his references.

L. - I've watch a close friend of mine go through this situation. The ladies who are telling you to move back to Colorado right away are telling you EXACTLY RIGHT. And follow all the other advice about getting them registered for school and getting your driver's license changed and getting a job as quickly as you can. Plus, FILE FOR DIVORCE IN COLORADO RIGHT AWAY (You can always drop the proceedings later if things change and you can reconcile). Whoever files first will establish what county/state the proceedings will be held in (think - travelling back and forth for court!) Also, most importantly, the court will establish the county/state of residency for the children and everything and anything to do with the custody of the children will be dealt with through that particular court. It will be nearly impossible to move the children out of that jurisdition without the other parent's approval, once the papers have been filed. If I were you, I would contact an attorney in Colorado, right now and tell them your situation. Set up the groundwork before you go. Then, I would run as fast as I could to Colorado and file as soon as you can. (Like I said, you can always drop the proceedings later if things change.) If he files here first, he will establish the residency for the children as Texas and you will be stuck. Call a Colorado attorney and find out the residency requirements before you can file anything there. And, just be as nice as you can to your husband - whatever you can do to keep him from filing first.... Good luck. I know this is a terrible situation. I hope you guys can work things out.

I was forced to check out all the laws myself a few years back. ANGELA had excellent advice. You may not want to, but please call your family and friends and move back to Colorado as quickly and quietly as you can. Then go to a temp agency and try to get even one day's work. Once you have worked even a tiny bit and have met the residency requiurement: usually you have to live there a length of time and have one bill showing your address, and the fact that you are working (no matter how minimal) you are in a much stronger position to call the shots. You and your children will be in my prayers!

If you are still technically married (no separation papers or anything), then move back to colorado NOW... Establish residency (according to their family law) and THEN file for divorce after the baby is born.

He CAN stop you from moving if either of you file here. He CAN'T stop you from moving as long as neither of you have filed papers...

It's true, you cannot divorce in TX while pregnant. They will ask you during the precedings. I was seperated over a year and my ex wouldn't help pay for the divorce even though he already lived with his now wife at the time. I had been seeing someone myself 6 months by the time I scraped up money and filed for divorce. We had 3 kids. I had just found out I was prego. by my boyfriend, and didn't mention it at all during precedings for fear they wouldn't let me divorce. Complicated situation, but my ex didn't contest the divorce, he didn't even show up, and it took about $1100 and all of about 30 minutes to get it done. I even paid an extra approx. $100 to have my maiden name back. My sister in law lives in Las Vegas, and she was prego. with number 3 when her husband moved out. He divorced her and moved in with another woman all while she was pregnant. Either during or after a pregnancy, it's the visitation rules and the child support you will want enforced, and for now-try not to stress you and your baby out. The way I look at it if he's a dog enough to leave you in your condition-good ridence. I'm still with that boyfriend, and we now have 2 children together, and he raises my 3 as well from my ex-husband. We've been together 7 years now. You will find a man that will love you and your kids and respect you in the end.

I can't recommend any attorneys, but I am pretty sure your husband cannot hold your kids prisoner in TX. You should be able to relocate back to CO without a problem. Best of luck to you and your children.
