I have had temporary custody of my grandson for a little over 3 years .His mother, my daughter wants him back and I am ok with that ,she has matured and Grown up since I filed for custody, My question is Does anybody know the process in what we have to do for this

Are you his guardian or do you have custodial (parental) rights. If you were granted "guardianship", then I think it's pretty simple. You would need a lawyer, but I think in that case it's a matter of you relinquishing your guardianship. If you were given parental/custodial rights then I THINK your daughter needs to file a legal petition and essentially go through the process to "adopt" her son from a legal standpoint.

I would definitely contact whatever attorney you used to obtain custody and have him/her walk you through this process.

I am not a lawyer.

If the courts granted you custody - then you might need to go back through the courts to get it reversed.

I would contact the lawyer who helped you get custody in the first place to see what he/she has to say.

My aunt went through this with my cousin and her kids several years ago. When my cousin was ready to take her kids back with my aunt's support, they had to prove that my cousin was fit and had fulfilled all of the court's mandates before the court would approve the change.

Once temporary custody is granted, you must have social services verify the stability of the parents' home and income source as well as safety for the child. They may have to complete Parenting class before the court will be allowed to even consider re-placing the child with the parent. It will have to be decided by a judge in family court. The child should have a legal guardian to ensure the best placement for the child and the court should appoint one.

Your first step would be to see what the limitations were for 'temporary' custody. It could be that if you surrender him, he may be moved to foster care until the legal work is done. Your daughter should start the petition in court - not you.
