Hi moms!

I don't know if anyone will have any suggestions on this but I wanted to give it a shot. I have a friend who is thinking of filing for bankruptcy and needs referrals for attorneys to go talk to. She lives in North Dallas but would be willing to do a little traveling. She doesn't have a lot of money to waste so she would prefer an attorney that doesn't charge for the initial consultation. Also if you have any suggestions on what questions she should ask the attorney so she gets the most out of that consultation that would be great also. She has mostly credit card debt etc. that she is hoping to get rid of. Thanks for your help!

I've been a paralegal almost 10 years and have done bankruptcies (both business and corporate). I know that there was legislation pending to rework the guidelines to which a personal bankruptcy can be done. Basically, it will make the debtor more responsible for paying off debts rather than just wiping the slate clean and them being relieved of their debts completely. I do not know if that has passed since having my son 2 years ago, I haven't kept up with much legal news.

An attorney worth his weight will never charge for an initial consultation, but most do require that once you sign them, a retainer be paid before any legal work commences on her filing. This can be anywhere from $500 to $1500. If the retainer runs out, she will be expected to refresh it before they continue work on her behalf. Some firms do them for a flat fee basis (depending on the circumstances).

She can go through several sources to find an attorney, though word of mouth is good... she can easily just do a search for bankruptcy attorney Dallas Texas at www.dogpile.com and I'm sure someone's got a website she can look at and contact. There are plenty of attorneys in the metroplex that she shouldn't have a problem finding one.

Prevost and Shaff are wonderful. My exhusband and I used them a couple of years ago and they were excellent. They're in the book and the initial consultation is free. Good luck to your friends!

I don't know the situation but maybe before she talks to an attorney she could talk to a finacial planner. My friend is one and her advice and planning is all FREE! She's great and very sweet. She's a divorced mom and certified Financial Planner.

Her name is Anne Salick ###-###-####.

Hi T.:

Here is another alternative. If your friend finds she cannot file bankruptcy, try this company. They restructure debts only.

It's geared to help people pay off their 30 year mortgage in less than ten years but they help will all debts. This results in a better credit rating rather than the BAD one that comes with a bankruptcy.

No More Mortgage
1-800-401-9304 NMM Extension 180

I am a representative for this company so contact me if you have any questions. It's free to get a financial analysis at the above mortgage and no obligation. Kits are also available if you would rather do it yourself than use the company. Ask me to email the order form.

Best wishes,

D. G.
